Alcohol takes time to absorb, and it takes time to dissipate. The same is true for drugs, either prescription, over-the counter, or illicit. Due to this absorption, a test of your blood, breath or urine will not accurately reflect the amount of alcohol or drugs in your system at the time of driving. Alcohol must be fully absorbed into your system before it starts to be eliminated. As it continues to absorb, your test result may rise significantly by the time you are tested.
Based on the problems of absorption, you may want to have an independent blood or urine analysis conducted as soon as possible after your release from custody. The results may be able to be used to refute the government’s chemical test results. Blood and/or urine tests may be obtained from your doctor or a private laboratory. In Nebraska, you may request your own independent test at your expense after the officer has completed his test. The officer is not required to assist you, but may not interfere with your ability to obtain an independent test.
